Some of the landowners have told me personally that they will have law enforcement up there citing people for tresspass.  Should be interesting to see if they follow through.

Are these people in the Bingham Land  Association?

Something to consider this year...
I was on a flight with one of the land owners in December and he told me the land owners wouldn't be so against such rides if they didn't have to spend a month afterwards picking up beer cans and misc. trash left behind...

Trash seems to be a problem everywhere. Is RCRC going to do another clean up there soon?

Hey Im not a club member but I would be more than happy to pitch in and help out on a clean up day at coalmine!....It is truly a shame that a bunch of IGNORANT people will go up there and ruin it for everyone.... Anyway, as of now, I will be up there on that ride and if there is going to be a clean up day Please let me know.

RCRC gets blamed for some of this trash so If the landowners block access with authorities we will offer to clean the trail.

The club typically has 1-2 rides per month and we kind of make every ride a clean-up ride.  We carry trash bags with us and take the opportunity to pick up trash each time we stop.  Although this isn't a large scale clean-up, every little bit helps.

I'm with you though... it's a shame that some people ruin it for the rest of us.  I personally don't understand how someone can just toss a can out instead of tossing the empty one right back in the cooler.  It makes me wonder what their front yard look like...

Ive heard the police thing every year. We have permission by different land owners on all sides of that mountain to ride there so Im not really worried about that. The closest thing Ive ever seen to cops around there was last year when they were pullin drunks over at Paint Rock X-ing

It never ceases to amaze me at how people have no qualms about littering.  When I hike in the Sipsey, I always have a trash bag tied to my pack for other peoples trash and I've yet to finish a hike without it being full and sometimes working on my second bag of trash.  Some people have zero respect for anything.

Count me in for a clean-up/trail run.  I'll be glad to do my part and then some.

It's nice to see there are so many people on here willing to clean the place up. I've seen pics on here before of the clean-ups on coalmine, and it has amazed me how much trash was collected. Too bad the amount of people willing to clean up are out-weighed by those that throw trash everywhere.
A couple of my buddies came up there last easter ride from down here in Auburn, and i think we're planning on doing that again this year. We'll be on sport quads if we do make it.

That would be me- Last year 2 guys came up where we were cooking , and one was about to run outta gas and was pretty far away from where he parked his tow rig. They said they were from outta town so I pulled the return line off my gas tank and cycled the fuel pump a few times and gave the guy a gallon of push-water. They were riding sport 4-wheelers . Just thought it mightve been yall.

Yeah that had to have been them. We're all from the huntsville area, moving down here for school. We all used to take our trucks up the mountain and ride on the weekends. We all still have 4x4s, but we like to take the quads out too. I've never had my 450 up there, and i know i'd have a good time.
Plus i'd like to meet some of yall up there.

I just got an invite to this from a co-worker who's family are landowners there (if I understood him right).  I told him about the trespassing issues and he said that the area will always be closed off but that it WILL BE OPEN for the Easter run.  He also said that if there are any police/sheriffs there, they will be checking for DUI's on the outbound vehicles but not concerning themselves with the inbound traffic.  He also said they are preparing for a huge turnout this year after the numbers that came last year.

He told me that once he gets the details for times/dates/permissions and what not, he will let me know and I'll pass them on here if needed but I imagine some of you are probably more in the loop than I am.

Again, we were both working on seperate projects and just passing by so we didn't have time to really go into detail but I thought that was what he said.  I very easily could have misunderstood that part and probably did.  I think I was also excited to know that the run was actually going to happen since it seemed to be up in the air so I may have selectively misunderstood him. lol

I can tell ya itll happen. It does every year. Heads up though , Its extremely crowded and there are alot of drunk idiots. Im not  against having a couple beers or whatever but theres a point when it gets outta hand when theres that many people driving around hammered off their arshe.

Yeah he was talking about that.  He said that there are a lot of people there who don't seem to "know when to say when" when they are out there.  I'm not against having the beers but I prefer to leave that to the campfire discussions at night AFTER we are done driving.

Okay, that helps me a lot. What i call the dug out must be clay hill then, cause as soon as you pass it you turn left and head up to the strip mines.
So then the rocky side up the mountain is actually called coalmine? Gotcha.
Is anyone else going up that way?

Its been about 8 years since I rode up that way , but if I remember right you gotta go up behind Paul Fowlers house , cross a creek and head up . You come out at the other side of the power line. I dont even know if that way is fit for a rig, as the last time I went that way it was on a honda. Nick may know.....

Far as I know there is no legal access to come in from dry creek. My cousin's in-laws used to own the land at the bottom of that trail and we would park on it and ride atv's up to his buddies cabin to camp. The land they owned has since been sold, so I haven't been that way in years. I would think it would be best to stay away unless you have permission.

I was riding with people that owned land on Dry Creek side. So permission wasnt an issue for me, I was just asking if one got permission from a landowner, if the trail was fit for a rig. Sorry for the confusion.

Thanks, Nick.  Our property is next to Dry Creek hunting club, there is probably no way to get there from our property.  I was just interested in where it was located, I thought maybe it was the powerline.  I'm not from this area just getting an idea where things are located.

The way we used to go up was a little ways before you get to the powerlines on the left side of the road. There was an old house place that my cousin's wife's family owned along with quite a bit of land. He had a buddy who owned a cabin up on the mtn that we camped in. That was the only way I have ever been up on that side and the road was basically just wide enough for an ATV. That was several years ago and I don't know anything about it now so I just stay out.

No problem. I just wanted to make it clear that I don't have permission to go in from dry creek anymore and I don't want anyone to get the wrong impression.

There are a few landowners on the coalmine/bingham mtn areas that are totally against offroaders in general. I totally understand their frustration, but they are laying the blame in the wrong place. Probably everyone on this website and definately all RCRC members are not the ones causing problems and trashing their land. RCRC has hauled TONS of trash off that mountain and probably not a single piece was left by the people on this site. Even so, since there is no http://www.drunkenidiotsonATVs.com - www.drunkenidiotsonATV's.com they get on the local 4wd club website (which is us) and assume that everyone that rides out there is a member. RCRC has tried to be more than cooperative with the fellow landowners, but some refuse to even talk to us and continue to slander our name.  Our club could be a valuable asset to the landowners if they were willing to work with us.

People who are passionate about this sport are generally good stewards of the land. It's the people who just go to get drunk and tear something up that give all off roaders a bad name. These people would not even consider joining a 4wd club, but still we get blamed for others actions. The actions of a  few can ruin it for everyone.

All of us on here need to get the word out to to the general off roading public that if they don't start respecting peoples property there is not gonna be anywhere left to go. When I got into this sport about 10 years ago you could ride about anywhere. Now days it's hard to find somewhere to go at all. Even places I regarded as public land , such as Tellico are under the gun. It's a crying shame that my 2yr old son will never even get to see some of the places I've enjoyed.

Sorry for the long post, but I'm tired of seeing gates go up and trails being shut down because of the actions of a few who won't respect others. Like I said, I don't think anyone on this site is part of the problem, but we need to get the word out to those who are. If we don't, nobody will until it's too late and another gate goes up somewhere else.

The same thing (club being blamed for litter) has been happening at Monteagle with the Damn Locals in Coppinger Cove. The land owners assume that since theres a 4x4 organization in the area , that everybodys a part of it, including the people throwing out all their trash. I think TNMAN (Locals Prez) had a meeting with the landowners a while back to clear thier name. That might be what ya'll have to do if you havent done so already.

I and three other guys wound up on that route once, coming down from the top.  We were stopped and escorted off the property by a landowner.  It wasnt at gunpoint, but he had a gun, and he basically told us that we could go out with him or Richard Brown (the major property owner at the base of the mtn) would have us arrested.  We left and havent been back.

Ok so Im a lil concerned. I have always been up there by going in through Killingsworth Cove. Is that a legal way to go in? I have been up there typically in my Jeep and occasionally with one other rig.

TECHNICALLY its tresspassing.  Part of the stairsteps trail is actually a county road, but not all of it, and once you get off the county ROW, you're on private property, no different than someone's yard in Cliff Cove subdivision.  The issue is whether or not the actual landowners want to push the tresspass.  Its my understanding of the law in Alabama (and I am no lawyer, but I did stay at a Holiday Inn Express....once....) if you are on someone's property, and its not your property, if you dont have written permission from that landowner in your possession, you are tresspassing.  But someone has to a) catch you and b) press the charge.  Generally, no one does unless they have some reason to do so.  Also, in Alabama, you cannot prevent someone from accessing their legally owned/deeded property - but that access does not have to be convenient.  As as far as I know, this does NOT apply to a lease.

Again, this is anecdotal, from talking to a lawyer and from talking to someone who manages lots of the land in the area in question.

Some will say, "I've been going there for years!"  So what, that means nothing.  This country's laws are based on private ownership of land, and the laws and law-enforcement folks all must respect that private ownership...most of the time.  You go there purley at the pleasure of the landowners whose land you are crossing.

Thanks for the info. Now my question is How do I go about getting permission to go up there using this route. Or better yet, which way is the legal way ? The last thing I want to do is get nailed for trespassing.  That is one of my favorite places to go here locally so I it would be nice to be able to continue riding there.

coal mine landowners are battleing everyone  and each other right now to keep the gat locked

as far as i know if you aint with a land owner or own land anyway you go up is trespassing

the new market side is county to the gate and no further and gated and now they have made bypassing it impossible with large rocks and ditches so good luck

That's discouraging. Judging by your name on here i'm assuming you are one of the Payne's. I've heard of yall and seen some of your rigs. And if YOU are saying good luck getting up there, sounds like i need to pay attention to this.

Is your XJ locked?

Welcome to the forum btw.  The trail I've been on I was able to manage pretty well on 33's with open diffs and IFS.  As to what trail I was on...  I couldn't tell ya.  I was just following the next rig in front of me.  I'm still trying to figure out where the heck we were. LOL

It would depend on the weather and how recently it has rained. I think you would be ok with a lil help in the tougher spots, if it is somewhat dry.

yeah landowners have been at it for a while and now are going at each other.
the county hauled gravel for the road to the gate, but after that a private contractor was hired to build/maintain the road by the landowners association.
if they leave it open you can get up but if locked who knows about a key to get in or out cause they have changed locks a couple of times recently. dont know about other routes up like stairsteps. havent been there in a while.
from what i understand the hurricane side you can take a 2wd to clay hill if you can get in

tried stairsteps yesterday after all the rain got up pretty far but there was no traction at all on the rocks. we had to turn around after the first big area of rocks after the mud. dont know if ill be trying it again. maybe it would be easier when it was dry but it seems to me youd need 35s to make it all the way. anybody ever made it with 31s and open diffs?

i made it all the way to powerlines and crawled around powerlines in this xj
which was open on 31s. just put the tires at 12psi and walked it around alot of stuff. but i got the job done.

I would really like to go to that, but its the same night as the city planning commish meeting whee they are going to talk about the subdivision that is planned for my backyard.

EDIT - the developer has pulled the proposal (again, second time) so no need to go to City Hall, so I am going to try to go to this.
