homeschool hazmat?

A buddy of mine who is heavily involved in the local Asbury Methodist Thift Store sent me this:

Being in the homeschool community, this law is forcing the "mom & pop" publishers and creators of homeschool products to close.  They can't press CDs or have their workbooks or story books or other printed articles sold because they have to do the hazmat testing on their products.  Due to the small market, many do their printing and publishing at a Staples or Office Depot.  Doesn't matter if their books or CDs "are not likely to" contain hazmat.  We believe this is going to kill many home based businesses.
Interperetations of this law apparently are that it may also require all used items sold, which MIGHT potentially be used by minors, to be evaluated for lead, and mercury, and whatever else, at the sellers expense.  This has the potential to put an end to garage sales, thift stores, and sites our our own for-sale forum.
 
Yep, nothing like stimulating the economy.

Uh oh, don't get Dei started. She helps out at the homeschool store next to the Asbury thirft store. They're calling Feb. 10th National Bankruptcy Day. Funny thing is that the backers of the bill and everyone says it isn't as bad as the press is making it out to be, however the text of the bill is worse than anything that's been reported yet. Even the CPSC "clairifications" don't help. For instance the latest one states that consignment and thrift stores don't have to "test items IN INVENTORY", however the next paragraph states that they will be subject to the penalties should they sell anything found to have lead.

Take a look at the toy department at Wal-mart, whether it's inventory or what, the toy section is pretty sparse, particuliarlly any isle with plastic building blocks, and action figures. One item mentioned in the bill is an addative to plastics that makes it soft. Wonder why LEGO decided to discontinue Duplo building blocks?

This is real nuts, problem is that the general consensus in congress is "don't worry, it isn't that bad" so they aren't listening. This can affect more than thrift stores, Books are specifically mentioned as part of this, so the national libraries are even considering having to close the children's sections. So much for "No Child Left Behind". Home made crafts makers are all impacted, so no more wooden rubberband guns, and junk at tourist locations, and it even applies to that native americian home made blanket you picked up at the reservation. Oh and let's not forget yard sales. Next time you have one, make sure if a government vehicle drives up you are "just showing off your stuff".

Problem is this doesn't even allow you to give the stuff away.

Democracy in Action - An Interactive Civics Lesson for your Students

“… that this nation, under God, shall have a new birth of freedom — and
that government of the people, by the people, for the people, shall not
perish from the earth.”

If you buy or sell anything for children 12 and under, you are probably
well-aware of the Consumer Product Safety “Improvement” Act (CPSIA)
that went into effect on February 10. (If you’ve missed that memo –
there is much information about it on the web. One good place to start
is: www.overlawyered.com. Or to see it from a homeschooler's
perspective, check out: http://www.clcandcpsia.blogspot.com.)

Countless numbers of us across the country have been petitioning
Congress for the last 2 months to get them to repeal, or at least
amend, this far-reaching law. Numerous hearings have been scheduled,
and canceled, between those who are struggling under the weight of this
law and those in Congress who refuse to budge. Finally, out of
frustration, many of those in the “this law has to be fixed” groups
have organized their own hearings: This Wednesday, April 1, from 10 to
11:30 a.m. there is an “Amend the CPSIA” Rally in Washington, D.C.
Citizens from all over the country will be gathering to address this
issue.
 
For those of us who are unfortunately unable to attend, they
will have it available on streaming video20on the website:
www.amendthecpsia.com. We plan to watch it as part of our Government
Club. And of course, you can watch it in your home, as your own
Interactive Civics Lesson. There will even be a live online chat as
part of the event. And they would love to hear your students’ reactions
afterward; you may send those comments to:

It is important that we help bring attention to this law, in hopes that
Congress will finally deal with it once and for all. This is also a
great way for students to see and be a part of the Democratic process
in action. Please spread the word to all you know who might be
interested.
