State Sovereignty Bill Introduced! -- Rep. Mac Gibson introduced a State Sovereignty bill to the Alabama House of Representatives last night, during their special session! http://www.theattackmachine.com/diary/553/state-sovereignty-bill-introduced-in-the-alabama-legislature I know Shoals Tea Party has been working really hard to get this going, and now all of the Alabama tea party organizers have been made aware. It is time for us to apply pressure on our state representatives and senators about this bill, so that Alabama can pass a resolution that will help protect us from too much federal government intrusion into our lives, our pockets, and our way of life. If you do not know who your representatives are, call the Board of Registrar to find out! 532-3510. I have mixed feelings about the state sovereignty bill. A few states have done this already and it hasn't been challenged, but it's kind of an empty gesture. One, its already "protected" by the constitution and two when this has been seriously challenged it's been shot down. A good example of this is Tennessee and Montana. These two states passed a law that said firearms made inside the state and sold inside the state and used inside the state were not subject to ATF or any other Federal regulation. The ATF responded with the court backed opinion that it is impossible to create anything without operating in interstate commerce. Even if you mine the metal and create your own plastic to make firearms if you use any tools created in another state that is interstate commerce. Even if you specifically use tools created inside the state and harvest only the state's natural resources you are particiapting in interstate commerce because you use federal roads/highways or air/water for power generation which crosses state lines and are subject to taxation and therefore is interstate commerce.
in short, bills like this are silly because while the 10th hasn't been repealed, the spirit of the law has been absolutely raped. until states get serious about refusing federal grants and using federal assets, they cannot pass bills that say they are sovereign and expect them to mean doodly squat. |
