"The National Highway Traffic Safety Administration is expected to announce a new regulation requiring all vehicles to contain a 'black box.' Not only that, but the devices would be designed to make it difficult (possibly illegal) to modify what information these devices collect or to disable them even though the courts have ruled that the owner of the vehicle owns the data. The courts have also ruled that authorities may access that data (to what degree and whether a warrant is necessary depends on the state)."

If the vehicle owner also owns the data, wouldn't the 5th amendment largely rule out its use short of a court order?  That is, assuming you didn't sign away access to it as part of your next insurance policy renewal.  Not sure even that would apply if requested outside of court by the other guy or his insurer.

All that crap you sign when you but a new car, that's where they'll get you with some fine print garbage that states anybody can have access to any black box info. 
 
There is already so much recorded data in a newer car right now anyway I don't see what good it would be outside of a crash investigation.  ABS modules already record speed, yaw, pitch ect when a crash signal is detected and that data can be retrieved with a scanner.  Although if the insurance company could look at how many times we all exceeed posted speed limits, well at least I'd be bumming a ride. Ouch
